The agreement
Spotlit is operated by Annastacia Kioko. These terms are between you and Annastacia Kioko. The Privacy Policy explains the personal data the product handles, including YouTube, TikTok, and Instagram. If these terms and the policy both speak to the same point, the policy wins on privacy and these terms win on everything else.
The product
Spotlit hosts one creator page per account: a portfolio, stats, a media kit, a link-in-bio page, and a brand inquiry form. The Free plan includes that page. Pro is the paid plan described on the Spotlit homepage at the time you subscribe, billed in Kenyan shillings. Features marked as coming soon are not part of what you have paid for until they are available.
Your account
You must be at least 18. Use your own name and an email you can open. You are responsible for the password and for what happens through the account. Tell us at annetotoh@gmail.com if you think someone else is using it. A handle has to be available and must not pretend to be another person or brand.
What you put on the page
You keep ownership of the text, images, and other material you add. You give Spotlit permission to host it, display it in the product, and show it to the public if you publish. That permission lasts while the material is on the service, and ends when you remove it or the account is deleted, except for copies already made by visitors or required for a backup that we then delete on the normal cycle.
You promise that you have the rights to what you upload, including thumbnails, and that the stats and audience figures you type are not presented as measured when you know they are not. A published page can be viewed, shared, and indexed. Take it down by unpublishing if you no longer want it at its public URL.
YouTube, TikTok, and Instagram
Connecting a platform is optional. You authorize Spotlit to read the data described in the Privacy Policy and to show the parts you keep on your page. We will not post, comment, or send messages as you. You can disconnect at any time in the editor. Disconnecting deletes the tokens we stored. Numbers and posts already saved on the page remain until you change them.
You must follow YouTube’s, TikTok’s, and Instagram’s own terms when you connect them. Those companies can change or revoke access. If a sync then fails, the page keeps the last figures you saved, and you can type over them. Platform data is only for your own Spotlit page. You may not pull it out of Spotlit to build another product, an ad audience, or a dataset.
Inquiries and brand deals
A brand inquiry is a message to you, stored in your dashboard. You decide whether to reply and on what terms. Spotlit is not a party to any deal, does not hold the money for a campaign, and does not promise that brands will write to you.
Acceptable use
Do not:
- Break the law, or post content you do not have the right to use.
- Impersonate another creator, or claim measured stats you know are false.
- Try to reach another person’s account, or probe the service for a way in.
- Scrape Spotlit, or overload it.
- Use a connected YouTube, TikTok, or Instagram account for anything other than filling your own page.
Plans and payment
The price is shown before you pay. Paystack takes the payment. A card plan renews each period until you cancel it from the billing page, and you keep Pro until the end of the period already paid. M-Pesa pays for one period and does not renew. Paying again before that period ends extends from the current end date, so unused days are not lost.
A period that has already started is not refunded, except where the law says it must be. If you live in the EEA or the UK, you keep any cancellation right that the law there does not allow a contract to take away. Taxes that Paystack or the law add are your responsibility to the extent the checkout shows them.
Stopping
You can delete the account yourself in Settings → Manage, or by emailing annetotoh@gmail.com. How deletion works is in the Privacy Policy. We can suspend or close an account that breaks these terms, or that we need to close to protect the service or someone else. We will tell you by email when we reasonably can.
We may change or stop Spotlit. If we shut it down, we will email the address on the account when we reasonably can, and you can ask for a copy of your page content before it is deleted.
Disclaimers and liability
Spotlit is a tool for presenting your work. Stats depend on what YouTube, TikTok, and Instagram return, and on what you type. Platforms and Paystack can be unavailable. We do not promise a particular number of inquiries or brand deals.
To the extent the law allows, Spotlit is not liable for lost profits, lost deals, or loss of data caused by a platform outage. Nothing in these terms limits liability that the law of Kenya, or the mandatory law of your country if you are a consumer in the EEA or the UK, does not allow a contract to limit. That includes fraud, and death or personal injury caused by negligence.
Law
These terms are governed by the laws of Kenya. Courts in Kenya may hear a dispute. If you are a consumer in the EEA or the UK, you also keep the right to bring a claim in the courts of the country where you live, and any mandatory consumer protection of that country still applies.
